PRAIRIE ATLANTIC WARRANTY FOR HYPERDRIVE SSDs & RAM PRODUCTS  

(Warranty is only valid in USA and Canada)   

 

LIMITED LIFETIME PRODUCT WARRANTY   

Prairie Atlantic Limited. (“PRAIRIE ATLANTIC”) warrants that its Products are free of defects in design, assembly, material and workmanship for the life of the Products (the “Warranty”).  This Warranty is valid only for the original purchaser of the PRAIRIE ATLANTIC Product. PRAIRIE ATLANTIC warrants to the original purchaser of any HYPERDRIVE & its RAM Products (“Product”) for the life of the Product, that the Product shall be free of defects in design, assembly, material, and workmanship.  

 

PRAIRIE ATLANTIC will repair or replace, at its option, any defective Product for the original purchaser free of charge. Original purchaser must register online or send in the Warranty Registration card in order for this warranty to be effective. Upon return for replacement of the Product, the original purchaser will be required to send a copy of the receipt to verify the original owner of the product. The Products are not for use with aquariums or on any water-related products. The Products and the equipment must be used only indoors in a dry location, and in the same building.  

 

Limited Ten-Year Warranty – Prairie Atlantic® Basics Memory 

PRAIRIE ATLANTIC warrants to the original end customer that its Prairie Atlantic Branded Basics memory products are free from defects in material and workmanship affecting form, fit, and function. Any claim alleging that any product fails to conform to the foregoing warranty must be made within ten (10) years from the original date of purchase, and PRAIRIE ATLANTIC shall have no liability thereafter. Any claim alleging that any product fails to conform to the foregoing warranty may be made only by the end customer who originally purchased such product and only while such customer owns such product. PRAIRIE ATLANTIC, at its option, will repair, replace, or provide an in-store or online store credit or refund of either the original purchase price or fair market value, whichever is lower, of any product that is determined by PRAIRIE ATLANTIC to be defective during the warranty period. 

 

Limited Three Year Or Limited Five Year Warranty – Prairie Atlantic® HYPERDRIVE SSDs 

PRAIRIE ATLANTIC warrants to the original end customer that its Prairie Atlantic Branded solid state drive products are free from defects in material and workmanship affecting form, fit and function. For SSD products sold on or before August 1, 2019, any claim must be made within three (3) years from the original date of purchase, and PRAIRIE ATLANTIC shall have no liability thereafter. For SSD products sold after August 1, 2021, any claim must be made within three (3) years or within five (5) years, depending on applicable warranty period for the SSD product purchased, from the original date of purchase or before writing the maximum total bytes written (TBW) as published in the product datasheet and as measured in the product’s SMART data, whichever comes first. PRAIRIE ATLANTIC shall have no liability thereafter. If there are multiple versions of a product datasheet and the TBW measurement changes between versions, the warranty shall default to the version that was valid at time of purchase. Any claim alleging that any product fails to conform to the foregoing warranty may be made only by the end customer who originally purchased such product and only while such customer owns such product. PRAIRIE ATLANTIC, at its option, will repair, replace, or provide an in-store credit or refund of either the original purchase price or fair market value, whichever is lower, of any product that is determined by PRAIRIE ATLANTIC to be defective during the warranty period. 

 

v. Information on Warranty Replacements 

Products presented for repair or replacement may be replaced by refurbished products of the same type rather than being repaired. Refurbished parts may be used to repair the products. Please ensure that you have saved the data stored on the product elsewhere and then delete all such data from the product prior to returning it for repair, replacement, refund in-store or online store credit. 

You must have proof of purchase and obtain warranty service authorization from PRAIRIE ATLANTIC, including a Return Materials Authorization (RMA) number within the applicable warranty period before returning defective products to PRAIRIE ATLANTIC. 

 

vi. Inspection and Return Procedures 

If you experience any problems with a Prairie Atlantic memory product or SSD within 30 days of purchase, please contact the place of purchase for return procedures. If you purchased the product directly from PRAIRIE ATLANTIC, inspect the product within 45 days of receipt (30 days for factory recertified SSDs), such period being a reasonable period to examine the product for defects or shortfalls, and notify PRAIRIE ATLANTIC promptly of any nonconformance. Failure to notify PRAIRIE ATLANTIC or the original retailer within the above time periods will constitute acceptance of the product for all purposes. No product may be returned for any reason without obtaining an RMA number from PRAIRIE ATLANTIC. You are responsible for returning the product to PRAIRIE ATLANTIC at your risk and expense. You are responsible for any duties and taxes due on replacement product sent from PRAIRIE ATLANTIC. Refunds are only applicable to new product purchased directly from www.prairieatlantic.com and within 45 days of purchase (30 days for factory recertified SSDs) for new memory or new SSDs. 

 

To obtain an RMA number for your defective product, use the chart below to find your region-specific website (RMA website) where you can quickly get an RMA number. You can also obtain an RMA number by contacting a customer service representative, but you will receive the fastest possible service online. 

 

Once you have an RMA number, package your defective product according to the instructions in the section below (“How the Return Process Works”). Any return of the product (with proof of purchase) should be made in a timely manner and at your expense. 

 

CRITICAL COMPONENTS AND CRITICAL APPLICATIONS.   

CUSTOMER ACCEPTS ALL LIABILITY FOR USE OF PRAIRIE ATLANTIC PRODUCTS IN LIFE SUPPORT DEVICES OR SYSTEMS OR IN ANY OTHER CRITICAL APPLICATIONS. PRAIRIE ATLANTIC PRODUCTS ARE NOT AUTHORIZED FOR USE AS CRITICAL COMPONENTS IN LIFE SUPPORT DEVICES OR SYSTEMS OR OTHER CRITICAL APPLICATIONS. Life support devices or systems are those which are intended to support or sustain life and whose failure to perform can be reasonably expected to result in a significant injury to the user. Critical components are those whose failure to perform can be reasonably expected to cause failure of a life support device or system or affect its safety or effectiveness. Critical applications are those applications in which failure of the PRAIRIE ATLANTIC product could result directly or indirectly in death, personal injury, or severe property or environmental damage. CUSTOMER ACKNOWLEDGES THAT ALL SEMICONDUCTOR PRODUCTS EXPERIENCE FAILURE RATES, WHICH MAY VARY ACCORDING TO USE CONDITIONS AND OTHER CIRCUMSTANCES. CUSTOMER ACKNOWLEDGES AND AGREES THAT CUSTOMER IS RESPONSIBLE FOR ALL DESIGN DECISIONS REGARDING CUSTOMER’S PRODUCTS AND IS SOLELY RESPONSIBLE TO IMPLEMENT SAFETY MEASURES TO GUARD AGAINST THE POSSIBILITY OF INJURY OR DAMAGE IN THE EVENT OF A FAILURE OR MALFUNCTION OF A PRAIRIE ATLANTIC PRODUCT USED IN A CUSTOMER PRODUCT OR SYSTEM. SHOULD CUSTOMER PURCHASE OR USE PRAIRIE ATLANTIC PRODUCTS FOR ANY CRITICAL APPLICATION, CUSTOMER SHALL INDEMNIFY AND HOLD PRAIRIE ATLANTIC HARMLESS AGAINST ALL CLAIMS, COSTS, DAMAGES AND EXPENSES AND REASONABLE ATTORNEYS’ FEES ARISING OUT OF, DIRECTLY OR INDIRECTLY, ANY CLAIM OF PRODUCT LIABILITY, PERSONAL INJURY, OR DEATH ARISING IN ANY WAY OUT OF USE OF PRAIRIE ATLANTIC PRODUCT IN A LIFE SUPPORT DEVICE OR SYSTEM OR OTHER CRITICAL APPLICATION. 

WARRANTY TRANSFER  

You may not transfer this Warranty.  This Warranty terminates if you sell or otherwise transfer a warranted Product to another party.   

  

WARRANTY SERVICE NOTIFICATION  

1.   Contact PRAIRIE ATLANTIC customer service by phone or email to place a claim request.   

2.  Complete Return Merchandise Authorization (“RMA”) form and submit to PRAIRIE ATLANTIC 

      a.     Submit form to warranty@prairieatlantic.com 

      b.     Please include any pictures or claim information if applicable.  

3. Upon receipt of completed form, PRAIRIE ATLANTIC will issue you an RMA number within 48hrs.  

4.  Upon receipt of defective Product, PRAIRIE ATLANTIC will inspect the Product to determine the cause of failure.   

      a. Removing the cover or tampering with the Product will void the warranty immediately.  

      b. After inspection, if the Product is free of any sign of Occurrence and working within design          specification, the Product will be returned to you with a test report and explanation of the claim rejection.

6. All Product Warranty and Connected Equipment Protection claims must be made within 20 days of the incident.  

7.   This Warranty is valid in USA and Canada.   

  

GENERAL  

If you have any questions regarding the limited Product lifetime warranty or the connected equipment protection limited warranty, please contact the PRAIRIE ATLANTIC Customer Service Department at +587 579 7575. This warranty supersedes all previous warranties. This is the only warranty provided with the Product and any other implied or expressed warranties are non-existent. This warranty may not be modified except in writing, signed by an officer of Prairie Atlantic.    

 

NO OTHER WARRANTY OF ANY KIND IS MADE UNLESS EXPRESSLY PROVIDED HEREIN, WE DISCLAIM ALL  

OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANT ABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES IMPLIED BY, AND INCAPABLE OF EXCLUSION UNDER, APPLICABLE LAW AND SUCH IMPLIED WARRANTIES, IF ANY, ARE LIMITED IN DURATION TO THE TERM OF THIS WARRANTY. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. WE DO NOT ACCEPT LIABILITY BEYOND THE REMEDIES PROVIDED FOR IN THIS LIMITED WARRANTY.  IN NO EVENT SHALL PRAIRIE ATLANTIC BE LIABLE FOR INCIDENTAL, SPECIAL, DIRECT, INDIRECT, CONSEQUENTIAL OR MULTIPLE DAMAGES SUCH AS, BUT NOT LIMITED TO, LOST BUSINESS OR PROFITS ARISING OUT OF THE PURCHASE OR USE OF ANY PRAIRIE ATLANTIC PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH MAY VARY FROM STATE TO STATE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGE, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
